Maria and W.R. Prestie were married in 1987, divorced in 1989, but remained on good terms. In 1994, W.R. executed a pour-over will and a living trust in California, leaving his estate to the trust, with his son Scott named as trustee and beneficiary. Neither document provided for Maria. As W.R.’s health deteriorated due to macular degeneration, Maria provided care, moving in with him in 2000. In 2001, W.R. amended the trust to grant Maria a life estate in his condominium. Shortly after, they remarried. W.R. passed away about nine months later. Maria then petitioned the district court for a one-half intestate share of W.R.’s estate, arguing that the will was revoked as to her.
