Polmatier v. Russ

Russ and his infant daughter visited the home of Arthur R. Polmatier. During the visit, Robert Polmatier witnessed Russ atop A.R. Polmatier, beating him with an empty beer bottle.
As Robert ran to get help for his father, Russ ran into A.R. Polmatier’s bedroom, grabbing ammunition & a rifle from the house’s bedrooms. Russ proceeded to shoot and kill A.R. Polmatier.
Some five hours after the incident, Russ was found naked atop a tree stump about one half mile from the Polmatier home, holding his infant daughter. The shotgun was found near Russ along with blood-stained clothes which he wrapped his daughter in.
After the incident, Russ was taken to a nearby hospital for a psychological evaluation. The doctor, who testified during trial, determined Russ was suffering from a severe case of paranoid schizophrenia—which included delusional thoughts & auditory hallucinations.
Dr. Borden concluded, based upon his medical evaluation, Russ was legally insane and could not form a rational choice during the incident.
