Plaintiff, Steven Pfau, and Defendant, Bruce Trent, were both students at Parsons College in Iowa. Steven was a domiciliary of Connecticut, and Trent was a domiciliary of New Jersey. While at college, Bruce drove a car that was registered in New Jersey in the name of the Trent Aluminum Company, a New Jersey corporation owned by Bruce’s father, and insured in New Jersey by a New Jersey carrier. Bruce was using the car with his father’s consent.
On April 22, 1966, Bruce agreed to drive Steven to Columbia, Missouri for a weekend visit. Shortly after leaving the college, while still in Iowa, Bruce collided with an oncoming car driven by Joseph Davis. Mr. Davis, his wife, and their child, all domiciliaries of Iowa, were injured in the accident. Their claims were settled by Bruce’s insurance carrier.
Steven was also injured in the accident, and brought suit against Bruce and Trent Aluminum Co. (Trent Aluminum) for negligence in New Jersey state court. Bruce and Trent Aluminum argued for the application of Iowa’s guest statute, which precluded a guest-passenger from suing the host-driver for ordinary negligence. Neither New Jersey nor Connecticut had a guest statute. The trial court found in favor of Steven. Bruce and Trent Aluminum appealed. The appellate court reversed. Steven appealed to the Supreme Court of New Jersey.
