In response to a call, Diane Kasler, an emergency medical technician, came to the home of defendant Laura Sergio. On observing Sergio and traces of blood in the bathroom, she asked Sergio if she was or had been pregnant. Sergio answered, “No.” Sergio was transported to Lutheran Medical Center. After questioning Sergio’s sister, the police found a newborn baby girl in a garbage bag outside the Sergio’s home. The baby died soon after of exposure and Sergio was charged with murder. The People contend that the physician-patient privilege does not apply to the statement made to the EMS volunteer who was not a physician.
