The Defendant, McGee, went to a gambling club with his friend, Linck. The pair had a couple of drinks and went into the card room of the club. Linck joined a card game for a little while and then the Defendant took his place at the table. The Defendant then left the card room and he and Linck went out of the club. The pair returned to the card room because Linck believed he had left $40 on the card table. When the pair was walking out of the card room into the dimly lit area of the bar to leave the club, the Defendant unintentionally shot a man named Rypdahl. Rypdahl died the next day at the hospital as a result of hemorrhaging from the bullet wound.
