A decedent was shot and killed while visiting a residence. The defendant had called a 911 operator and stated that he had been attacked in his home and shot the assailant, the decedent. When police arrived, they questioned the defendant and the other guests. While police were questioning the defendant, the decedent’s girlfriend shouted “You shot him in the back for no reason.” The defendant did not reply, instead he remained seated with his hands partially covering his face and mouth. The girlfriend’s statement was admitted at trial. The defendant was convicted of manslaughter. The defendant appealed.
