Alice Raymond and her husband, Claude Raymond, executed mirror-image wills on January 15, 1979, leaving their estates to each other upon death. When Claude passed away in February 2000 and Alice died in February 2005, the residuary clause of her will came into effect. The will specified that the estate would be divided equally between Alice’s surviving siblings and her husband’s surviving siblings. At the time of Alice’s death, only two of her eight siblings and three of her husband’s eight siblings were alive. The petitioner, one of Alice’s surviving brothers, filed a petition for probate and later sought to have the will construed in June 2005.
