Seibert (defendant) was arrested for her involvement in the fire of her family’s home in which Donald, a mentally ill teenager, was found dead. An officer questioned Seibert at the police station for 30 to 40 minutes without Miranda warnings. After Seibert admitted that she knew Donald was meant to fire in the fire, she was given a 20-minute break. The officer then began recording the interview, gave Seibert Miranda warnings, and obtained a signed waiver of her rights. He then prompted Seibert to repeat the same information she had given prior to the warnings. The trial court suppressed the prewarning statement but admitted the responses given after the warnings.
