Property Keyed to Rabin
Minonk State Bank v. Grassman
Facts
Property was conveyed to Agnes, Gustav, Ida, and Frieda Grassman as joint tenants. Gustav and Frieda died, after which Ida Grassman (Defendant) conveyed her interest to herself for the purpose of dissolving the rights of survivorship that was created in the original conveyance. Agnes died next, leaving Defendant the only remaining tenant. Minonk State Bank (Plaintiff), administrator of Agnes’s estate, sought a declaratory judgment to determine what interest Agnes’s estate had in the property in question and to force a sale. The trial court declared Defendant the sole surviving joint tenant, and therefore the sole owner of the entire estate and dismissed the other claims. The appellate court reversed, holding that Defendant’s conveyance to herself terminated the joint tenancy, giving her only an undivided one-half interest in the property. Defendantwas granted the current appeal.
