In 1884, John Rigney conveyed a parcel of land to the Tacoma Light and Water Company (TLWC). The deed made the conveyance subject to the condition that the TLWC use the parcel of land to supply water to the residents of the City of Tacoma, and if the parcel of land ever stopped being used for that purpose, Rigney’s heirs retained a right of re-entry. TLWC utilized the land for the purpose of supplying water to Tacoma residents until 1893 when they conveyed the property to the City of Tacoma. The City of Tacoma also used the land for water supply until 1905 when the parcel was set aside for park purposes. The Metropolitan Park District of the City of Tacoma (the plaintiff-appellee) was created in 1907 and has ever since had management over the land. In 1920, tennis courts were erected on the parcel for public use and, though they have fallen into disrepair and are rarely used, remain on the parcel.
