Facts

The case concerned a long-running dispute over a piece of land in Virginia that formerly was owned by Lord Fairfax, a British loyalist. The State of Virginia claimed that it had lawfully seized Fairfax’s land prior to the Treaty of Paris in 1783, which ended the Revolutionary War. Virginia subsequently granted parcels of land to some of its citizens, including Hunter. Martin claimed ownership of the same parcel of land, tracing his claim to a devise from Fairfax in 1781. Martin claimed that Fairfax’s lands had been protected from seizure by the Treaty of Paris in 1783. Hunter filed a suit in Virginia state court in 1791.
