The defendant decided to trade in his 1957 Imperial on another Cadillac. Before trading it in, the defendant took it to the shop. At this point, the defendant discovered that there were two cracks on each side of the Imperial’s motor block. The plaintiff hired a worker to apply Permatex to conceal the cracks. Later on, the defendant brought the Imperial to the plaintiff’s shop and began to negotiate trading it in. The defendant did not tell any salesman or the sales manager about the cracked block. The parties eventually agreed to a trade. The Imperial was later reconditioned and sold for $2,476.08. The purchaser returned the next day and complained that it was overheating. The car was taken to the plaintiff’s shop to verify the purchaser’s complaint. At this point, the plaintiff finally discovered the cracks in the motor block. the plaintiff refunded the purchaser’s money. The plaintiff then sold the Imperial to a second buyer, who had the knowledge of the cracked motor block, for $1,200.
