Plaintiff sued to enforce the provisions of two similar contracts against the defendant. Under the contracts the defendant was required to pay for certain minimum quantities of gas from wells for natural gas where the plaintiff had a minimum percentage interest. When the price for gas declined, the defendant did not pay the plaintiff for gas prices on the theory that it was purchasing gas from the plaintiff’s co-owners at reduced prices. The defendant also declined to pay the minimum quantities of gas which were not taken.
