Gary Jones (Plaintiff) failed to pay property taxes on his house in Arkansas. The Commissioner of State Lands mailed a certified letter to Jones’s address in an attempt to notify Defendant of his delinquency and of Commissioner’s right to seize the property. The letter was sent back unclaimed. Two years later, Commissioner sent another letter to Plaintiff, notifying him of the pending sale of Plaintiff’s property to Linda Flowers (Defendant). This letter was also sent back unclaimed. Plaintiff’s house was then sold to Defendant. Later, Plaintiff discovered that his house was sold and filed a lawsuit alleging that the Commissioner failed to provide adequate notice.
