The plaintiff alleged that the defendant raped and assaulted her in a bedroom at a private party. Upon leaving the room, the plaintiff located her friend, Ryan Dadmun, and asked him to drive her home. The plaintiff did not report the rape to anyone else that evening. The next morning Dadmun drove plaintiff to another friend’s house. The plaintiff was then taken to a hospital where she spoke with a nurse. The nurse reported the crime to the local police department. The police department would use the Dean of Students of the plaintiff’s college to set up an interview with the plaintiff. During the interview, the questioning detective encouraged the plaintiff to confide in her parents about the incident. The plaintiff did later disclose to her parents about what had allegedly happened. The defendant was later charged with rape and assault and battery in criminal court. The plaintiff later testified before a grand jury. However, the grand jury did not issue an indictment to the defendant.
