In a commercial lease, the defendant was required to maintain comprehensive general public liability insurance with respect to the subleased premises and the conduct and operation of business. The plaintiff supposed to be added as an additional insured. The defendant obtained comprehensive general liability insurance for the subleased space, but failed to add the plaintiff as an additional insured under the purchased property. Someone suffered personal injuries on the premises and sued the plaintiff for those injuries. The plaintiff in turn, brought a third-party claim against the defendant alleging a violation of the lease’s insurance procurement provision.
