In 1995, Michael Jordan (plaintiff) entered into an endorsement agreement with WorldCom, Inc., (defendant) which gave the latter a ten-year license to use Jordan’s name, likeness, and services to promote its products. Jordan could still promote other products so long they were different from Worldcom’s. In 2002, WorldCom filed for bankruptcy. Jordan filed a claim for the $8 million he alleged he was owed under his contract. WorldCom countered that Jordan’s contract was an employment contract that obligated him to mitigate his damages, which he failed to do.
