On March 1, 1950, petitioner and William Curtin leased 160 acres of farmland from Gleeson at a rate of $6 per acre and a share of the profits. The lease automatically renewed on March 1, 1951 and March 1, 1952. In the fall of 1951, petitioner and Curtin sowed wheat for harvest the following year. On February 14, 1952, Gleeson died. Pursuant to her will, petitioner was nominated the executor of the estate and trustee of the trust. Petitioner continued on as tenant and farmed the land with Curtin. He discussed such continuance with the beneficiaries and raised the cash rent to $10 per acre. Petitioner’s appointment as trustee was confirmed on April 29, 1953 and on July 22, 1953, petitioner submitted his first semi-annual report. However, the report was not approved and on December 5, 1953 he submitted a recast report. Respondents objected to the report.
