The plaintiff incurred a debt to the defendant, and ended up falling behind on the payments. The defendant offered the plaintiff the opportunity to settle the debt for less than the owed amount. The terms of the settlement included a provision that the derogatory information regarding the plaintiff’s credit information would be settled through this settlement. The settlement provided two dates and corresponding amounts that would need to be paid for the debt to be considered settled. The plaintiff sent the money in a timely fashion, and it was received. Some time later, the plaintiff discovered that the negative credit information had not been removed from his account, upon which he brought suit.
