Plaintiff was employed by defendant for twenty-five years. At age sixty-five, plaintiff informed his employer of his intention to retire. Plaintiff spoke with an officer and a shareholder of the company, informing him of his retirement, and the officer assured the plaintiff that the company would “take care of him.” During this conversation, there was no mention of a sum of money or percentage of salary the plaintiff would receive. As a token of appreciation, the defendant paid plaintiff $5,000 for his “many years of service.” Plaintiff continued to visit the employer after his retirement and would inquire as to how long the checks would continue. The payments continued in the same amount on an annual basis for four years. After several years of poor business and an ownership change within the company, the payments ceased. Plaintiff brought suit against his former employer to enforce the pension.
