Goodman v. Dicker

With Goodman’s (defendant) encouragement, Dicker (plaintiff) applied for a dealer franchise to sell products from Emerson Radio and Phonograph Corporation. Goodman represented to Dicker that the application would be accepted, and the franchise would be granted. Goodman also represented to Dicker that he would receive an initial delivery of 30 to 40 radios. No radios were delivered, and Goodman gave notice to Dicker that the franchise would not actually be granted. Dicker sued Goodman to recover damages for the money he spent in preparation for the franchise business. The trial court awarded Dicker damages for cash outlays and the anticipated profits on the sale of 30 radios.
