Gianni v. R. Russel & Co.

Gianni (plaintiff) rented a room in an office building where he sold tobacco, fruit, candy, and soft drinks. R. Russell & Co. (defendant) acquired the office building and the plaintiff signed a three year lease for his room. The new lease prohibited the plaintiff from selling tobacco. The plaintiff contends that in consideration for not selling tobacco, he was orally given exclusive right to sell soft drinks in the building. The signed, written contract did not include this stipulation. The defendant then entered into a lease agreement with a drug company and did not prohibit the company from selling soft drinks. The plaintiff then sued defendant for breach of contract.
