Criminal Procedure Keyed to Allen
Georgia v. Randolph
Citation:
547 U.S. 103 (2006)Facts
Police were called to a home for a domestic dispute between Respondent and his wife. The wife told the officers that her husband was a cocaine user. Respondent countered that he was not a cocaine user and explained that he had removed their child to a neighbor’s home out of concern that his wife might take the child out of the country. An officer asked the wife for consent to search the house which she gave. She led him upstairs where he found a straw covered with a substance that looked like cocaine. The officer left the house with the straw to get an evidence bag from his car, and when he returned, the wife withdrew her consent for the search. The police took the straw and later returned with a search warrant, found drugs, and arrested Scott Randloph for possession of cocaine.
