Reynoso (defendant) purchased a combination refrigerator-freezer from Frostifresh Corporation (plaintiff). The contract for the refrigerator-freezer was negotiated orally in Spanish between Reynoso and a Spanish speaking salesman who represented Frostifresh. A contract was later given to Reynoso that was written entirely in English for the purchase of the refrigerator-freezer at a sales price of $1,145.88. The actual value of the refrigerator-freezer was only $348.00. The written contract was neither translated nor explained to Reynoso. Nevertheless, Reynoso, signed the contract. Reynoso eventually defaulted after making one payment for the refrigerator-freezer in the amount of $32.00. Frostifresh sued Reynoso to recover the rest of the purchase price.
