Cleveland police received a tip that a person wanted in connection with a recent bombing was hiding at a residence and that policy paraphernalia would be found there. The officers knocked on the door and demanded to enter, but Mapp (defendant) refused to let them in without a search warrant. Three hours later, the officers tried to enter the home again. When Mapp did not come to the door, the officers forcibly opened a door and entered. Mapp demanded to see a search warrant and an officer produced a paper they claimed to be a warrant. A struggle ensued over the “warrant” and Mapp was handcuffed. The officers searched Mapp’s entire residence and found obscene books and pictures, which Mapp was charged and convicted of possessing.
