Root agreed with another to conduct a street race which took place on a 3 lane highway. The traffic was light and the weather was dry and clear at the time of the race. The speed limit on the highway was 50 mph; however, root and his competitor were averaging speeds from 70-90 mph during the race. At the time of the accident, Root was in the lead in the right hand lane of travel. In an effort to pass, Root’s competitor veered into the other lane, in a no passing zone, and crashed head on with an oncoming truck, killing Root’s competitor.
