Rementer and his girlfriend, Mary Berry, were at a bar together. The bartender noticed that the couple were arguing, and Berry became “very upset” and was “crying hysterically.” Shortly after, Berry left the bar and got into her car. Rementer followed her, shoved Berry into the passenger seat of the car, and drove off.
Several witnesses saw Rementer hit Berry and pull her hair as she attempted to escape the car. Berry escaped twice, but Rementer pulled her back into the car and continued to beat her each time. The third time Berry escaped the car, she ran to a passing vehicle for help while Rementer chased her. The driver became scared and sped off, and Berry was crushed to death beneath the wheels of the vehicle.
Rementer was charged with murder. Rementer testified that he pulled Berry back into the car each time to prevent her from hurting herself and “making a scene.” He claimed that he did not intend to injure Berry or cause her death. Rementer was convicted. He appealed, arguing that the evidence at trial was insufficient to prove that his conduct caused the death of the victim.
