Commonwealth v. Magadini
Citation:
52 N.E.3d 1041 (Mass. 2016)Facts
Magadini was a native of Great Barrington, Massachusetts and had been homeless since 2004. In winter 2007, Magadini lived for short time in a homeless shelter in Great Barrington, but was told to leave. Magadini was aware of another homeless shelter twenty miles away in Pittsfield, but he did not have a driver’s license and did not want to leave his hometown. He then lived outdoors year-round in a public park. In 2014, Magadini was charged with seven counts of trespass on three different properties: Barrington House, Castle Street, and SoCo Creamery. At the time, Magadini was barred from each property under no trespass orders. On February 21, March 4, and March 6, 2014, police found Magadini in the hallway of Barrington House lying near a heater in the evening, nighttime, and early morning hours. He was found again walking around Barrington House on April 8 at around noon. On February 20 and March 28, 2014, police found Magadini in the early morning hours lying near a heater in Castle Street. Finally, on June 10, 2014, Magadini entered the restroom of SoCo Creamery for ten to fifteen minutes.
