On January 30, 1947, the defendant, along with Edward Hough and David Almeida, engaged in an armed robbery of a supermarket. An off-duty policeman, who happened to be in the area, was shot and killed while attempting to stop them from escaping. Although the evidence as to who fired the fatal shot was conflicting, the court instructed the jury that it was irrelevant who fired the fatal bullet, even if it was a police officer who fired the bullet.
The jury convicted the defendant of first degree murder, under the theory of felony murder. He petitioned for a writ of habeas corpus. The Court of Common Pleas of Philadelphia County denied it. He appealed, and is now in the Supreme Court of Pennsylvania.
