Chicago Coliseum and Dempsey entered into a written contract for Chicago Coliseum to promote a boxing exhibition with Dempsey and another well-known boxer. The contract with Dempsey required in relevant part for Dempsey to have life and health insurance as determined by Chicago Coliseum and refrain from participating in any other matches leading up to this exhibition. Chicago Coliseum additionally entered into a contract with the other boxer and a skilled promoter regarding this boxing exhibition.
Leading up to the exhibition, Chicago Coliseum sent Dempsey a letter requesting that he submit for a health examination for purposes of the insurance. Dempsey responded with a telegram refusing to submit to the examination as he was busy training for an upcoming match and otherwise denying the existence of a contract.
