Chae Chan Ping v. United States
Citation:
130 U.S. 581 (1889)Facts
Chae Chan Ping (Petitioner) was a man originally from China who lived in San Francisco from 1875 to 1887 and worked as a laborer. He left the United States to visit his family in China and acquired a certificate allowing reentry before leaving. However, he was denied reentry to the country upon his return. This was because a week before his return to the U.S. in 1888, Congress amended the Chinese Exclusion Act of 1882, which prohibited Chinese laborers from entering the country. The amendment annulled Ping’s certificate of reentry and terminated his right to land. The captain of the ship upon which Ping arrived took custody of him and Ping filed a petition for relief. However, in 1868, the U.S. and China had entered into a treaty that allowed the movement of people between the two countries.
