New York’s Alcoholic Beverage Control Law (ABC Law) requires every liquor distiller or producer that sells liquor to wholesalers within the state to file a schedule of prices that includes an affirmation that the bottle and case price of liquor to wholesalers set forth in the schedule is no higher than the lowest price the distiller charges wholesalers anywhere else in the U.S. during the month covered by the schedule.
Defendant, the New York State Liquor Authority (Liquor Authority), initiated license-revocation proceedings after learning that Plaintiff, Brown-Forman Distillers Corporation (Brown-Forman), violated the ABC Law. In New York state court, Brown-Forman sought review of the Liquor Authority’s decision and argued that the ABC Law violated the commerce clause of the U.S. Constitution. The appellate division held that the ABC Law did not violate the Commerce Clause. Brown-Forman appealed. The Court of Appeals of New York affirmed. The U.S. Supreme Court granted Brown-Forman’s petition for certiorari.
