The plaintiff landlord owned and rented out numerous spaces for residential use as apartments. Later the landlord, in the same building, rented out spaces to bars and lounges. In the lease agreements with these bars and lounges the landlord included a provision that noise levels must be kept down such that they aren’t audible outside the establishment. Loud noises ensued anyway, greatly disturbing the defendant tenants. This went on for an extended period despite tenants’ complaints, and they left their units. Landlord sued.
