Facts
Gary Zurcher was involved in a motorcycle accident that resulted in severe injury and death. In a California state court, he sued the manufacturer of his motorcycles tires, Cheng Shin Industrial Rubber Co. Ltd. (Plaintiff), a Taiwanese company. Plaintiff filed a cross-complaint against the manufacturer of the tire’s valve assembly, Asahi Metal Industry Co. (Defendant), a Japanese company. Zurcher’s claims were eventually settled and dismissed, which left only Plaintiff’s claim against Defendant.
