However, the number of residences requiring trash collection increased by 400 rather than the expected 20-25 per year. Maher asked the city to adjust the contract to pay $10,000 more per year, and the city agreed. Plaintiff (Angel) sued the city and Maher on the grounds that the contract was unenforceable.
