The litigation surrounded the 7 World Trade Center Building (7WTC). During the September 11 attacks, flaming debris was spewed into the area surrounding 7WTC. Fires burned on multiple floors. After burning for seven hours, 7WTC collapsed and destroyed the electrical substation owned by Consolidated Edison Co. of New York, Inc. (Con Ed), which was located directly underneath 7WTC. The plaintiff argued that 7WTC’s inadequate design and construction allowed the building to collapse. The defendants argued that 7WTC was properly designed and constructed, but simply could not withstand the events of September 11.
