Plaintiff and Defendant underwent in vitro fertilization that resulted in twin daughters. As part of this procedure the parties underwent seven individual egg-retrieval and insemination procedures after which some preembryos were preserved. Before each procedure, the parties were required to sign consent forms that determined the disposition of the preembryos for certain contingencies. Before the first IVF procedure, the Plaintiff filled out a consent form to indicate that “[s]hould become separated, [they] both agree[d] to have the embryo(s). . . return[ed] to the wife for implant.” Both parties signed the form after it was filled out. Before each of the remaining procedures the husband signed a blank consent form that the wife subsequently filled out.
Three years later, the Plaintiff had one of two remaining vials of preembryos implanted without the Defendant’s knowledge or permission. The Defendant send the Plaintiff a protective order, filed for divorce, and sought a permanent injunction to prevent the Plaintiff from implanting the final embryo.
