On May 12, 1893, the Atlantic Mills leased a property in the City of Providence to the lessee Riverside Worsted Mills. On December 4, 1936, Atlantic Mills assigned lessor rights to Plaintiff. On February 15, 1916, Defendant succeeded to the lessee’s rights and later completed four subsequent lease assignments. The first assignment on December 22, 1931, was to the Defendant’s subsidiary, National and Providence Worsted Mills, the second assignment on December 26, 1934, was back to Defendant, the third assignment on June 1, 1939, was to the Defendant’s subsidiary, the Textile Realty Company and the last assignment on November 21, 1939, was to a separate entity, the REO Realty company. Aaron J. Oster, the owner of this company, paid Defendant $630.30 for the leasehold interest and to claim title to a small vacant land owned by Defendant.
After becoming the assignee, REO Realty Company only paid one installment of rent. Plaintiff later sued Defendant to recover outstanding rent under the lease in the amount of $2,935.83 for the period between September 1940 and March 1941. The trial court ruled in favor of the Defendant and the Plaintiff appealed this decision.
