Apprendi shot several bullets into the home of an African-American family. Apprendi was convicted of possessing a firearm for an unlawful purpose. The trial court judge held an evidentiary hearing to determine whether Apprendi acted with the purpose of intimidating the family because of their race, which would allow for a harsher sentence under New Jersey’s hate crime law. Apprendi presented evidence that he did not have a racial bias. However, the trial court judge found by a preponderance of the evidence that Apprendi acted with the purpose to intimidate, and applied the sentencing enhancement imposed by the hate crime law.
