Federal Deposit Insurance Corp. v. Hadid
Facts
The National Bank of Washington (NBW) (plaintiff) advanced two loans, one to Keystone Financial Corporation (Keystone) and the other to P.S. Speculation Co., Inc. NBW consented to rebuild the credits if Mohammed Hadid (respondent) gave guarantees on the advances. The expressions for the rebuilding of the credits were set out in two composed reestablishment and augmentation agreements. The understanding for the Keystone credit gave that it was secured by a promise of normal stock in McDowell Enterprises, Inc. (McDowell). NBW sued to uphold the notes and assurances. Hadid contended that he and NBW had gone into an oral understanding, under which he would either be given control over the McDowell stock or his assurances would be void. The jury restored a decision to support Hadid. The district court granted NBW’s motion for judgment notwithstanding the verdict and entered judgment against Hadid for the notes, plus attorney’s fees. The Federal Deposit Insurance Corporation (FDIC) was substituted in the action after NBW was declared insolvent. Hadid appealed.
