Pappas v. Bever
Facts
Philip Bissonnette Jr. signed a form expressing that he "intend[ed]" to give $5,000 to Charles City College (school) over time. The promise form had been printed by the school fundraisers and was filled in with regards to the amount, the terms, and Bissonnette’s signature. Bissonnette gave the school $1,000 in 1967 and another $1,000 in 1968, the year the school closed down. Bissonnette passed a year later without having given any more money to the school. The collector of the then-closed school, William Pappas (plaintiff), sued the executor of Bissonnette's estate, Sondra Bever (defendant), to recuperate the rest of the $3,000 pledged by the form. The main evidence of the promise was the completed form and the two payments made by Bissonnette. The trial court held that the promising form was insufficient to demonstrate that the pledge made a guarantee. Pappas appealed.
