Coppage (Petitioner), an employer in Kansas, was found guilty of violating a Kansas state law that prohibited employers from asking employees not to join or remain a member of a labor union as a condition of employment. The Kansas legislature passed the act in 1903, which was designed to encourage the unionization of employees. Coppage was fined by the state after he was found to have required his employees to sign such a contract as a condition of their employment.
