Thomas A. Edison (Plaintiff) sued the Edison Polyform Manufacturing Company (Defendant) to restrain defendant from the use of the name “Edison” as a part of its corporate title or in connection with its business or advertisements. Edison formulated a topical pain-relief liquid, and Defendant manufactured and marketed a topical pain-relief liquid that was identical to Edison’s formula except that the company’s version did not contain morphine. The labels on the company’s bottles had Edison’s name and image, along with Edison’s purported certification that the company used his formula in manufacturing the liquid, but Edison had not provided such certification.
