California passed a law called the “Reproductive Freedom, Accountability, Comprehensive Care and Transparency Act” that required “crisis pregnancy centers” —mostly pro-life organizations that offer a limited range of free pregnancy options, counseling, and other services —to provide patients with notice about alternate free or low-cost access to family planning services offered by the state, including abortions. Authors of the legislation found that the crisis pregnancy centers aimed to discourage pregnant people from seeking abortions. The legislation required that licensed covered facilities disseminate government-drafted notices explaining that California had public programs to provide free or low-cost access to family planning services, prenatal care, and abortion. The notices must be posted in the waiting room, printed and distributed to all clients, and appear in English and other languages identified by state law. The second notice requirement covered “unlicensed facilities,” and had to explain that the facility was not a licensed medical facility by the State of California. Petitioners argued that the state law violated the First Amendment rights.
