Central Hanover Bank & Trust Co. (Plaintiff) consolidated over 100 individual trusts into one common trust fund. They filed a petition seeking a judicial settlement of the individual accounts in court. The New York Banking Law § 100-c(12) required notice of settlement to be filed in a local newspaper, which Central Hanover Bank did. Mullane (Defendant) was appointed to represent the beneficiaries who did not respond to the notice in the newspaper, and he argued that the publication of notice did not satisfy the requirements of the Fourteenth Amendment due process clause.
