Donald Odorizzi (Plaintiff) was employed by Bloomfield School District (Defendant) as an elementary school teacher in 1964, and was under contract with the school district to teach the following year as a permanent employee. While under contract, plaintiff was arrested on criminal charges of homosexual activity. Defendant sent the superintendent and the school principal to plaintiff’s home upon his arrest, requesting he resign immediately or they would need to suspend him and publicize his dismissal proceeding, as they were required to do by statute. Plaintiff did not have time to consult an attorney about this matter, according to the demands of defendant, and agreed to resign. He made this decision after his release from prison, with approximately 40 hours of no sleep. Plaintiff was later cleared of all charges and asked to be reinstated in his job. Defendant refused.
