Kajo Church Square, Inc. v. Walker

Don and Patsy Walker and Joe and Meriam Eakin (plaintiffs) transferred ownership of two parcels of land to a church. Part of the transfer of land was a gift and the other part was a sale. The church leased one of the parcels of land back to the Walkers and Eakins. The lease stated that it would continue until the last of them died. Four years later, the church sold their land and the church building to Kajo Church Square, Inc. and Kajo Trust (collectively “Kajo”) (defendants) respectively. One week later, Kajo notified the plaintiffs that it was terminating their lease. The Walkers and the Eakins brought suit, alleging that had either a life estate or a leasehold for life in the land. Kajo, on the other hand, alleged that the Walkers and Eakins only had a tenancy at will.
