On October 29, 1981, the plaintiff lost his right foot in a job-related accident at the defendant employer. The defendant then placed the plaintiff on a leave of absence at full pay from the date of his injury until August 16, 1982, at which date the plaintiff returned to the same job he had at the time of his injury. On March 11, 1983, the defendant laid off the plaintiff indefinitely. The plaintiff then filed this lawsuit, claiming that his firing was a breach of an oral contract, as he believed in good faith that he had a valid claim against the defendant for personal injury. He claimed that the defendant made an oral agreement with him to receive lifetime employment in exchange for not litigating the claim for personal injury. The defendant denies this ever happened.
