Pinnacle Property Management Services, LLC (“Pinnacle”) (defendant) hired Stephanie Prasad (plaintiff) as a property manager. Prasad required work accommodations as a diabetic. She was eventually placed on medical leave from Pinnacle for two weeks. Upon returning to work, Prasad learned that her position was filled by another employee. Although Prasad was reassigned to a new position, her new position paid less and was considered “temporary in nature.” Prasad filed a putative class, collective, and representative action against Pinnacle, who moved to compel arbitration pursuant to the parties’ Issue Resolution Agreement (“IRA”) provision within the employment contract.
