Facts
A patient sued a McGee for $10,000 in damages for McGee’s negligent operation on the patient’s hand, which left the hand gross and useless. The patient alleged that he reasonably relied on promises made to him by McGee that: it possessed the skill necessary to operate on his hand; the patient would recover in less than six days; and the scar would be small and hardly noticeable after healing. Instead, McGee experimented on the patient’s hand, causing the patient to stay in the hospital for three months and be left with a long and unsightly scar.
